Review the terms governing AI Influencer Creator accounts, subscriptions, credits, generated content, acceptable use, and service availability.

Introduction

These Terms of Service ("Terms") govern your access to AI Influencer Creator, including its character, image, video, account, credit, and subscription features. By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you use the service for an organization, you confirm that you have authority to accept these Terms for it.

You must be at least 18 years old, or the age of legal majority where you live, to purchase a subscription or use the generation features. The service is a digital software-as-a-service product delivered immediately over the internet.

Service and Underlying AI Models

AI Influencer Creator provides tools for creating reusable fictional character identities and generating AI images and videos from prompts and reference media. The service is independently operated and is not an official application of, sponsored by, or endorsed by any model provider.

Generation requests are routed through APIMart to the following underlying model families currently available in the product:

  • OpenAI — GPT Image 2 (provider route gpt-image-2).
  • Google — Gemini 3.1 Flash Image, also marketed by Google as Nano Banana 2 (provider route gemini-3.1-flash-image-preview).
  • Google — Gemini 3 Pro Image, also marketed by Google as Nano Banana Pro (provider route gemini-3-pro-image-preview).
  • ByteDance — Doubao Seedance 2.0, including the standard, Fast, and Mini service variants displayed in the video model selector (provider routes doubao-seedance-2.0, doubao-seedance-2.0-fast, and doubao-seedance-2.0-mini).

Provider route names may include preview or delivery-variant identifiers. The recognizable provider and model family are shown in the product interface. Available models may change when a provider retires, renames, or replaces a model; when that happens, we will update the selector and this disclosure. Selecting a different model never bypasses our content-safety requirements.

Accounts and Service Access

You must provide accurate information, keep your credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account and for ensuring that anyone using the account follows these Terms. We may change, limit, or discontinue features and models as the service and its providers evolve.

Subscriptions, Credits, and Payment

Paid plans, billing intervals, included credits, generation costs, taxes, and available models are shown on the pricing and checkout pages. Waffo Pancake is our merchant-of-record payment provider. By subscribing, you authorize the recurring charge shown at checkout. Monthly plans renew each month and annual plans renew each year until canceled. Applicable taxes may be added at checkout.

Plan credits are issued once each month, including for annual subscriptions. They expire at the end of that monthly credit period, do not roll over, and are replaced by the next monthly allowance. Credits are service units, not money, stored value, or transferable property. Different models, resolutions, durations, and reference media may consume different amounts.

Cancellation

You may cancel through Dashboard → Subscription → Cancel subscription. Cancellation stops future renewal and takes effect at the end of the already-paid billing period. You retain plan access until that date unless a refund is approved, the account is terminated for a serious violation, or applicable law requires a different result. Deleting the application account does not by itself guarantee cancellation of an active payment mandate; cancel the subscription first or contact us from the registered account email.

Refund Policy

Because access and monthly credits are supplied immediately as a digital service, subscription charges are generally non-refundable except under the conditions below. The same eligibility rules apply to Starter, Plus, and Ultra; differences in price or credit allowance do not create different refund rights.

Eligible refunds

  • First subscription purchase: A first-time subscriber may request a full refund within 7 calendar days of the initial charge if no more than 10% of the plan's first monthly credit allowance has been consumed. For an annual plan, an approved request refunds the annual charge and ends the subscription.
  • Duplicate or incorrect charge: A confirmed duplicate charge or billing error is eligible for a full refund of the incorrect amount.
  • Annual renewal: An annual renewal may be refunded when requested within 7 calendar days of the renewal charge and no credits from the renewed period have been used. Monthly renewals are not refundable merely because the user forgot to cancel.
  • Extended service outage: If a verified outage within our reasonable control prevents use of the paid generation service for at least 72 consecutive hours, we may provide a proportionate refund or service credit for the affected period.
  • Termination not caused by the user: If we permanently terminate a paid subscription for a reason other than a breach, fraud, non-payment, legal requirement, or misuse by the user, we will provide a proportionate refund for the unused prepaid subscription period where applicable.
  • Mandatory legal rights: Any withdrawal, cancellation, refund, or consumer right that cannot lawfully be excluded remains available. If local law gives you more favorable rights, local law controls.

Non-refundable situations

  • Requests made outside the eligibility windows above, including ordinary monthly renewals.
  • Credits or subscription periods already consumed beyond the first-purchase threshold.
  • Dissatisfaction with the style, quality, similarity, accuracy, or usefulness of an AI Output when the generation request was technically completed.
  • Unused monthly credits that expired under the disclosed no-rollover policy.
  • Price differences after a promotion, currency conversion, tax, or voluntary plan change, unless a billing error occurred.
  • Accounts suspended or terminated for fraud, chargeback abuse, or violation of these Terms or the content standards, except where applicable law requires a refund.

How to request a refund

Email connect@aiinfluencercreator.app from your registered account email with the subject Refund request. Include your account email, Waffo transaction or payment ID, plan and billing interval, charge date, requested amount, reason, and any supporting evidence. If the request concerns an unauthorized charge, say so clearly and secure your account immediately.

We aim to acknowledge a complete request within 2 business days and decide eligibility within 5 business days. We may ask for additional information; the review period pauses until it is received. Approved refunds are submitted to Waffo Pancake and the original payment method. Banks and card networks usually post the funds within 5–10 business days after processing, but timing can vary. Taxes and exchange-rate differences are handled according to payment-provider rules and applicable law. An approved full refund ends the refunded access and removes unused credits associated with that purchase.

Please contact us before opening a bank dispute so we can investigate a suspected billing error. This does not limit any legal right to dispute a transaction.

Generation Failures and Credit Returns

A generation can produce an imperfect or unusable result without being a technical service failure. When the platform confirms that an image or video task failed technically, the product workflow returns that task's charged credits to the applicable monthly balance. A credit return is not a cash refund and does not extend the monthly credit expiration date. A prompt rejected or held by content-safety verification is not sent to the generation model and is not charged.

Your Inputs and Generated Content

You retain any rights you already hold in prompts, character descriptions, and reference media you submit ("Inputs"). You grant us and our service providers a limited, worldwide license to host, copy, transmit, modify, and process Inputs only as reasonably needed to operate, secure, and improve the service, enforce these Terms, and comply with law.

Subject to these Terms, paid-plan features may permit commercial use of generated images and videos ("Outputs") as described on the applicable plan. This does not give you rights in a real person's likeness, a third party's trademark, copyrighted work, product design, music, or other protected material that may appear in an Input or Output. Outputs may not be unique, and other users may receive similar material. You are responsible for reviewing Outputs and determining whether your intended use is accurate, lawful, and appropriately disclosed.

Content Standards and Prohibited Generation Categories

You must obtain all permissions needed for Inputs and intended Outputs. The following six categories are expressly prohibited in prompts, reference media, generated content, publication, and storage through the service:

  1. Pornography or NSFW content: nudity intended for sexual gratification, explicit sexual acts, fetish content, sexual services, non-consensual intimate imagery, sexual violence, or attempts to digitally undress a person.
  2. Violence or gore: graphic injury, mutilation, torture, cruelty, glorified real-world violence, instructions facilitating violent wrongdoing, or content primarily intended to shock through blood or gore.
  3. Hate speech: content that attacks, dehumanizes, excludes, threatens, or promotes hatred or violence against people based on protected characteristics such as race, ethnicity, nationality, religion, disability, sex, gender identity, or sexual orientation.
  4. Child-unsafe content (CSAM): any sexualized depiction of a minor or person presented as a minor, child sexual abuse material, grooming, exploitation, or instructions that facilitate child abuse. This category is zero tolerance.
  5. Deepfakes or impersonation: using a real person's face, body, or voice without authorization to deceive, defraud, harass, create intimate content, fabricate evidence, or falsely imply endorsement, including impersonation of public figures.
  6. Copyright or trademark infringement: reproducing, adapting, or passing off protected characters, artworks, logos, product designs, trade dress, or other material when you lack the required permission or a valid legal basis.

We also prohibit terrorist or extremist propaganda, instructions for weapons of mass harm, self-harm encouragement, fraud, phishing, malware, unlawful surveillance, doxxing, defamatory content, deceptive political material, and any other illegal activity. Do not conceal a material brand relationship or present AI-generated media as verified evidence or the work of a human professional where that claim could cause harm. Follow applicable synthetic-media and sponsored-content disclosure rules.

Platform Content Moderation

Before every character, image, or video generation request, the user-supplied text prompt is sent to Waffo Prompt Sift with semantic enforcement enabled. Generation proceeds only when the verdict is allow. A block verdict is rejected. A review verdict—including a degraded moderation service—fails closed and is not sent to the generation provider until a later request receives an allow decision.

Prompt Sift is stateless and does not retain the prompt text after returning its decision. We may retain operational moderation metadata such as the request ID, verdict, reason code, matched policy categories, and semantic status so that we can investigate safety incidents and appeals without logging the prompt through this integration. Underlying model providers may apply additional safety checks to Inputs and Outputs. Content reported by a user or otherwise flagged may be reviewed manually before we decide whether to remove it or restrict an account. Automated systems are imperfect and do not replace user responsibility or human review.

The service does not currently provide a public gallery or public feed. If public publishing is introduced, additional post-publication scanning and reporting controls will apply before launch.

Reporting, Enforcement, and Appeals

To report generated content or conduct that may violate these standards, email connect@aiinfluencercreator.app with the subject Content safety report. Include the content or task ID, a URL or screenshot if available, the category of concern, why you believe it violates these Terms, and whether anyone faces immediate danger. Reports involving child safety, credible threats, or non-consensual intimate content are prioritized. We aim to acknowledge reports within 2 business days and resolve ordinary reports within 7 business days; complex or legally sensitive cases may take longer.

Depending on severity, history, and legal obligations, we may refuse a request, warn the user, remove stored content, restrict generation features, suspend or terminate the account, preserve evidence, or report suspected illegal conduct to relevant authorities. Confirmed CSAM, credible terrorism facilitation, or non-consensual sexual deepfakes may result in immediate termination and reporting where required. Attempts to bypass moderation are themselves a violation.

If you believe we acted incorrectly, email the same address within 14 calendar days with the moderation request ID or enforcement notice and an explanation. We aim to complete an appeal review within 10 business days. Submission of an appeal does not restore removed content or access while review is pending.

Prohibited Activities

You agree not to:

  • Violate law, regulation, court order, sanctions, or another person's rights.
  • Upload content you do not have permission to use, including private or confidential personal data.
  • Create or facilitate any content prohibited by the six categories and supporting standards above.
  • Mislead people about the identity, origin, sponsorship, evidence, or authenticity of generated media.
  • Bypass safety controls, usage limits, credits, authentication, rate limits, or access restrictions.
  • Probe or disrupt the service, distribute malware, scrape it at abusive volume, or reverse engineer protected parts except where law permits.
  • Resell account access, transfer credits, or use automated methods that create unreasonable load without written permission.

Our Service and Intellectual Property

The service, interface, brand, software, documentation, and other materials we provide are owned by us or our licensors and protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive right to use the service; they do not transfer ownership of the platform or its brand.

Termination

You may stop using the service at any time and may request account deletion through the contact address below. We may restrict or suspend access when reasonably necessary to protect the service or others, investigate suspected misuse, comply with law, address non-payment, or enforce these Terms. Where practical, we will provide notice and an opportunity to resolve the issue.

Third-Party Services

The service depends on APIMart, OpenAI, Google, ByteDance, Waffo Pancake, and third-party hosting, storage, authentication, email, analytics, and support providers. Their availability and policies may affect features, processing times, models, moderation, and Outputs. Third-party services may have additional terms that apply to your use. Listing a provider does not imply its endorsement of AI Influencer Creator.

Disclaimers

The service and Outputs are provided "as is" and "as available." Generative AI can create errors, bias, artifacts, unexpected similarities, or inaccurate content. We do not guarantee that the service will be uninterrupted, that a character will be identical in every generation, or that an Output is accurate, non-infringing, or suitable for a particular purpose. You must apply human review before publication or reliance.

Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunity, or the cost of substitute services arising from your use of or inability to use the service. Rights that cannot legally be limited remain unaffected.

Changes to Terms

We may update these Terms as the service, providers, or legal requirements change. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice where required. Continuing to use the service after the effective date means you accept the revised Terms.
